Its essence is to inform the competent authority of the architectural and construction administration about the planned intention along with a set of required documents.
The basis for the application is to provide information to the office on the scope of the works, the method of their execution and the date of commencement of works. The application is accompanied, among other things, by a land or land development project, an architectural and construction project and a statement on the right to dispose of the property for construction purposes. Depending on the type of investment, additional arrangements or opinions may also be required. A key feature of this procedure is the so-called tacit consent mechanism. If the office does not object within the statutory deadline, the investor may start the implementation of the works in accordance with the scope covered by the notification. However, the absence of an organ's response does not mean arbitrariness. The whole must fully comply with the technical and construction regulations and planning arrangements in force for a given plot.
The scope of investments that can be implemented on the application is strictly defined by the provisions of construction law. It includes, among other things, selected single-family residential buildings, outbuildings or certain construction works that do not have a significant impact on the environment. In each case, it is necessary to check whether the specific intention meets the statutory criteria and does not infringe the interests of third parties.
The importance of registering a construction in the investment process is primarily to reduce the time of formal preparation of the project. At the same time, it does not exempt from liability for the correctness of the documentation or from the obligation to comply with the regulations. Errors made at the filing stage may result in opposition from the office or problems already in the process of implementation. For the investor, this implies the need for special care in the preparation of documents and in assessing whether the investment in question actually qualifies for this form of procedure. The declaration of construction, although simplified, remains a full-fledged element of the system of construction law and requires the same level of precision as a classic permit.
