§ 1. Preliminary provisions
1. The owner and administrator of the website operating at www.brj-studio.com (hereinafter: ‘the Website’) is:

2. These Terms and Conditions set out the rules and conditions for using the Website. By accessing the Website and viewing its content, the User confirms that they have read these Terms and Conditions and accept their provisions. Use of the Website constitutes acceptance of these Terms and Conditions.
3. The User undertakes to use the Website in accordance with these Terms and Conditions and the applicable provisions of Polish and European Union law.
4. In matters not covered by these Terms and Conditions, the provisions of Polish law shall apply, in particular the Civil Code, the Act on the Provision of Electronic Services, and other generally applicable legal acts.

2. These Terms and Conditions set out the rules and conditions for using the Website. By accessing the Website and viewing its content, the User confirms that they have read these Terms and Conditions and accept their provisions. § 2. Definitions
For the purposes of these Terms and Conditions, the following definitions apply:

• Website – the website operating at www.brj-studio.com, together with all its subpages.
• User – any natural person, legal person or organisational unit without legal personality using the Website.
• Content – all materials published on the Website, including texts, graphics, photographs, architectural designs, visualisations, logos and layout.
• Terms and Conditions – these terms and conditions of use of the Website.

§ 3. Copyright and intellectual property
1. The Website and all its Content constitute works within the meaning of Article 1(1) of the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws of 2022, item 2509, as amended) and are subject to the protection provided for by law.
2. All exclusive rights to the Website and its Content – including copyright, trademark rights, database rights, rights to architectural designs and other materials – are vested in the Administrator or in entities from which the Administrator has obtained the relevant licences.
3. Without the prior, express and written consent of the Administrator, it is prohibited in particular to:
1. publish, copy, reproduce or further distribute the Website Content in whole or in part,
2.use the Website Content for commercial, marketing or advertising purposes,
3. modifying, adapting or creating derivative works of the Website Content,
4. posting the Website Content on other websites or social media platforms without citing the source.
4. Use of the Website Content is permitted solely within the scope of fair use for personal purposes, as referred to in Section 23 of the Act on Copyright and Related Rights.
5. Any breach of the above provisions entitles the Administrator to seek legal redress through civil or criminal proceedings.

§ 4. Terms of Use
1. Use of the Website is free of charge and does not require registration, unless the Administrator expressly states otherwise.
2. The user is obliged to use the Website for its intended purpose, in a manner that does not infringe the rights of other users or third parties.
3. In particular, the user is prohibited from:
1. interfering with the security, technical infrastructure or content of the Website,
2. taking any action intended to disrupt or prevent other Users from using the Website,
3. sending unsolicited commercial messages (spam), chain letters or other mass-distributed content via the Website,
4. uploading to the Website or via the Website any files containing viruses, malware or other elements capable of causing damage to computer systems,
5. attempting to gain unauthorised access to restricted parts of the Website, the source code or other users’ data,
6. publishing or transmitting content that infringes generally applicable laws, public decency or the rights of third parties.
4. The Administrator reserves the right to block access to the Website for any User who breaches the provisions of these Terms and Conditions or applicable laws.
2. The user is obliged to use the Website for its intended purpose, in a manner that does not infringe the rights of other users or third parties.
3. In particular, the user is prohibited from:

§ 5. Limitation of the Controller’s liability
1. The content published on the Website is for information purposes only and does not constitute an offer within the meaning of Article 66 of the Civil Code, nor does it constitute a binding legal obligation on the part of the Administrator, unless expressly stated otherwise.
2. The Administrator takes every care to ensure that the information published on the Website is up to date, accurate and complete; however, the Administrator does not guarantee its accuracy or completeness and accepts no liability for any errors or outdated Content.
3. The controller shall not be liable for:
1. damages incurred by the User in connection with the use of the Website or acting on the basis of the information contained therein,
2. interruptions to the Website caused by technical issues, maintenance work or circumstances beyond the Administrator’s control,
3. the content of third-party websites to which links are published on the Website; Users access such websites at their own risk,
4. advertisements, promotions or other forms of commercial communication from third parties displayed on the Website, where applicable.
4. The Administrator reserves the right to make changes to the Website – including modifying, removing or adding Content – at any time and without prior notice to Users.
5. The above limitations of liability do not apply in the event of damage caused intentionally by the Administrator, nor do they exclude the rights of Users who are consumers arising from mandatory provisions of law.

§ 8. Final provisions
1. These Terms and Conditions are governed by Polish law. Any disputes arising from the use of the Website or the interpretation of these Terms and Conditions shall be settled by the ordinary courts having jurisdiction over the Administrator’s registered office, unless mandatory provisions of law provide otherwise (in particular with regard to Users who are consumers).
2. If any provision of these Terms and Conditions proves to be or is deemed unlawful, invalid or unenforceable, this shall not affect the validity and enforceability of the remaining provisions. The invalid provision shall be replaced by a provision that most closely corresponds to the purpose of the invalid provision.
3. The Administrator reserves the right to amend the Terms and Conditions at any time. The amended Terms and Conditions shall come into force on the date of their publication on the Website, unless expressly stated otherwise. In the event of significant changes, the Administrator may notify Users by email. Continued use of the Website following the publication of changes constitutes acceptance of the new version of the Terms and Conditions.
