Land reclamation is a procedure that allows changing the use of agricultural land for non-agricultural purposes, most often for residential development. It applies when the plot is listed in the land register as agricultural land and the investor plans to implement the building. The mere fact of the location of the plot in the built-up area is not enough, since the possibility of development is determined by its formal status and current regulations.
In the Polish legal system, the classes of agricultural land, denoted by numbers from I to VI, are of particular importance. Land of classes I to III is considered land of the highest agricultural quality and is subject to the strongest protection. Their de-farming is much more limited and often requires the approval of the competent administrative authority, and in some cases may be unacceptable at all. On the other hand, land of classes IV to VI is treated as land of lower agricultural value, which in practice means a simpler formal path and greater possibilities for repurposing the land. Whether and to what extent deforestation will be necessary is also determined by the provisions of the local land use plan. If the plan provides for development on a given site, the exclusion of land from agricultural production can occur automatically at the stage of obtaining a building permit or when declaring an investment. In the absence of a plan, the decision on the construction conditions becomes crucial, which must take into account both the class of the land and its location.
The de-farming procedure is therefore closely linked to the formal analysis of the plot and the preparation of project documentation. Incorrect interpretation of the land class or omission of this aspect at an early stage can lead to delays or the need to change the investment assumptions. For this reason, de-farming is treated as an element of planning and not just an administrative formality. Knowledge of the system of land classes in Poland allows you to realistically assess the potential of the plot even before the start of the design. Thanks to this, the investor gets a clear picture of the possibilities of development, and the further stages of preparation of the investment can proceed in a conscious manner and in accordance with the applicable legal conditions.
