Is every plot with access really suitable for development? Not always. Not having formally secured access to a public road can effectively block your investment, even if you can “physically” get there by car.

Access to a land plot is one of the basic conditions for issuing a decision on the conditions of development or a building permit. However, this does not mean that the plot must be directly adjacent to the municipal or national road. It is sufficient that this access is provided in a formal way, through participation in an internal way, easement of passage or other record in the land register. The problem begins when the road exists only in the field, but there are no documents confirming the right to use it. The authorities are increasingly verifying this and do not recognize travel “on word” or on the basis of custom. As a result, the investor is left with a plot on which he cannot build anything until he regulates the legal status. Imagine this situation: you buy a plot of land, because a paved road leads to it. It is fenced, well-groomed, “everyone uses it.” You apply for a building permit and get a refusal. Why? Because you have no rights to this road. The owner is a private person who has not given consent, and the court easement can take many months. This is a real problem that could have been foreseen.

How to check if the land plot has legal access to the road? First of all: analyze the registration map, an extract from the land register and the land register. Note whether the plot borders the road plot (marked, for example, as “dr”) and whether there is easement or co-ownership of the internal road. If in doubt, it is worth asking an architect or a surveyor - people who know the regulations and can assess whether the access is sufficient from the point of view of the office.

Access to the plot is not just a recipe. It is also a matter of daily functioning. A narrow, muddy road, the inability to enter heavy equipment, the inability to build a descent - all this can make it difficult not only to build, but also to later life on the property. So it's worth asking yourself:”is it possible to put a house on a plot without access to a public road?” and make sure that the answer is consistent with the documents, not just the facts.
