Don't want to go through the whole process of getting a building permit? In many cases, you can use a simpler path - filing. But even then you need properly prepared documentation.
The application documentation is a set of documents that the investor submits to the office to declare the intention to build or perform certain construction works. Although the application procedure is less formalized than obtaining a permit, specific requirements still apply. The Office has the right to refuse to accept the application if the documentation is incomplete or prepared incorrectly. What is included in such documentation?
The basis is the declaration form for construction works. It is joined by:
- statement on the right to dispose of real estate for construction purposes,
- land or land development project,
- architectural and construction project,
- additional agreements and opinions — if required, e.g. environmental decision, technical conditions from media managers, opinion of the conservator.
In the case of single-family houses, especially within the framework of so-called “houses up to 70 m²”, the documentation can be simplified, but this does not mean that it can be prepared without care. The authorities are increasingly scrutinizing each attachment. Imagine the situation: the investor wants to quickly start construction and submits an application to the office. Attaches the project, but forgets about the statement of the right to dispose of the land. The effect? The Office calls for replenishment, and the 21-day deadline is suspended until the missing document is delivered. The whole process is delayed and the construction schedule is diverging even though it could have been avoided.
It is worth remembering that the application mainly concerns simple and uncomplicated investments - those that do not have a significant impact on the environment. This applies, among others, to single-family houses, garages, sheds, terraces, connections, fences above 2.2 m or some earthworks. But even with simple investments, the application documentation must comply with the provisions of construction law and the provisions of the local zoning plan. Is it possible to prepare the application documentation yourself?
Theoretically, yes, but practice shows that it is better to entrust this to a person with the appropriate rights - an architect. Thanks to this, you gain confidence that the documentation will be accepted by the office without unnecessary corrections and delays.
