Construction on request is a form of implementation of a construction investment that does not require obtaining a building permit, but still involves the obligation to complete certain formalities. In contrast to the full administrative procedure, the application allows you to start work faster - unless the office objects within the statutory deadline, most often 21 days from the date of submission of documents. It is this lack of decision on paper that is referred to as “tacit consent”.

Does this mean that one handwriting is enough and you can build right away? In theory, yes, but provided that the investment is included in the catalog of objects allowed for implementation on application. These include, but are not limited to, detached outbuildings, sheds, gazebos, fences, rainwater tanks, backyard sewage treatment plants, as well as some single-family houses - for example, houses up to 70 m² of built-up area, meeting specific technical and formal requirements.

In a typical situation, an investor who wants to build a small shed with an area of up to 35 m², submits an application to the mayor's office. If there is no objection from the authority and the object meets the conditions specified by the regulations (for example, the appropriate number of objects on the plot, minimum distances from the borders), it can start construction without the need to obtain a permit.

The application requires the preparation of a certain set of documents. Most often these are: a description of the planned investment, a project for the development of a land plot, a statement of the right to dispose of real estate, and in some cases also an architectural and construction project. Regardless of the simplified procedure, the investor must comply with the provisions of the local zoning plan or the decision on the conditions of development.

Construction by application in 2024 is a solution that simplifies the start of the investment and reduces the number of formalities, but does not exempt from liability. In case of non-compliance with the regulations, construction may be stopped or require legalization. It is an intermediate form between construction with a permit and minor works that do not require any notification. It works well with simple objects that do not significantly affect the environment, but must be done in accordance with the law.
